(I)Legal basis
1.It is stipulated in Article 11 of the Land Administration Law of the People's Republic of China that, ¡°s tate- owned land lawfully used by units under ownership by the whole people or under collective ownership or used by individuals shall be registered and recorded by local people's governments at or above the county level , which shall , upon verification , issue certificates to affirm their right to the use of such land ¡± .
2.It is stipulated in Article 8 of the Measures of Sichuan Province for the Implementation of the Land Administration Law of the People's Republic of China that, ¡°Province-level departments and enterprises and government institutions affiliated to provincial government (including enterprises and government institutions affiliated to the central government), which have legally acquired the right to use state-owned land, shall apply and register to the department in charge of land administration in provincial people ¡®s government, which shall, upon the verification of department in charge of land administration, issue the certificates for the right to use state-owned land¡±.
(II)Conditions of Applications
Any organizations or individuals who acquire the right to use state-owned land through allocation shall, within 30 days after the documents of using land are approved by local people's government at or above county level, apply for registration of defining the limit of right to use land with approved documents of using land.
(III)Submissions
1.Land Registration Application Letter;
2.Certificate of land registration and identification paper of legal person in cadastral investigation, copy of handling person's ID card, and authorization letter for delimitation;
3.Registration evidence of legal persons in offices and enterprises, industrial & commercial business license and copy of organization code;
4.Official document for land used in construction and permit for using land for construction purpose;
5.Planning permit for using land for construction purposes and red line plan (original copies must be provided for verification of the copies of above-mentioned materials, the received copies of documents must be sealed to prove that the copies are in conformity with the original ones).
(IV)Handling procedures and time limit
Procedures:
1. Submit materials at the Service Office of Sichuan Provincial Land Resources. Department in Government Affairs Service Center of Sichuan Provincial People's Government
2.Handle the land ownership investigation and ancestor land cadastration by Sichuan provincial land management and registration affairs center
3.Audit and joint review by Sichuan Provincial Land Resources Department;
4.Provincial Land Resource Department is responsible for registration and issuance of certificate.
Time limit: 1. Legal time: 20 working days; 2. Time promised: 20 working days
(V)Charging standards and basis
The charging of land cadastration for registration is subject to CZ [2001] No.94 Document issued by the State Planning Commission and Ministry of Finance. |
